Latest I-9 Form Update: Only expiration date extended

Last year, we updated you on the newest changes to the U.S. Citizenship and Immigration Services (USCIS) Form I-9, Employment Eligibility Verification, which involved extensive substantive modifications to various sections of the hiring form.  Employers are more than familiar with Form I-9 which verifies the identity and employment authorization of their newly hired employees.

The good news this year is that the latest update involves a simple date change.

So what exactly has changed?

U.S. Citizenship and Immigration Services updated the Form I-9, Employment Eligibility Verification to extend the expiration date to 05/31/2027.

Employers must use the Form I-9 with the edition date of 08/1/23, which may have an expiration date of either 07/31/2026 or 05/31/2027. Either form may be used until its respective expiration date. Downloads available on the Form I-9 download page will only include the new 05/31/2027 expiration date.  

Employers are encouraged to update their electronic Forms I-9 systems to use the 05/31/2027, expiration date as soon as possible and must do so no later than July 31, 2026, the expiration date on the previously-issued Form I-9.

What about the I-9 forms that my existing employees have already filled out?

No worries.  Your existing employees need not do anything.  The I-9 forms these employees filled out upon their initial hire are in compliance.  So long as at the time of hire, the current Form I-9 was completed, correct and unexpired documents were provided as verification, and the form was signed and dated, no updates are needed.

The expiration dates need only be of concern with new hires, so it is important that you as the employer provide the new employee with the correct I-9.
